Acceptance of Terms

These Terms of Use govern access to and use of Demen.

By creating an account, accessing the app, or using any Demen feature, you agree to these Terms.

If you do not agree, do not use the platform.

Purpose of Demen

Demen provides educational, organizational, communication, planning, legacy, caregiving, and grief-support tools.

Demen may help users:

• Begin family conversations
• Organize important information
• Record personal wishes
• Explore advance care planning topics
• Preserve memories and family stories
• Prepare funeral or memorial preferences
• Access educational grief resources
• Coordinate selected information with trusted people

Demen does not guarantee that using the platform will prevent disagreements, resolve family conflicts, create legally valid documents, or produce any particular medical, legal, financial, or emotional outcome.

Eligibility

Users must be at least 18 years old to create an independent account unless Demen later introduces a specifically authorized minor experience.

Users must provide accurate account information and must be legally capable of agreeing to these Terms.

Account Responsibilities

Users are responsible for:

• Maintaining accurate account information
• Protecting account credentials
• Securing devices used to access Demen
• Reviewing family-sharing permissions
• Reporting unauthorized access
• Keeping personal documents and wishes current

Users may not share passwords or attempt to access another person's account without authorization.

Appropriate Use

Users may not:

• Use Demen for unlawful purposes
• Impersonate another person
• Upload information they are not authorized to possess or share
• Harass, exploit, threaten, or harm another person
• Attempt to bypass security controls
• Introduce malicious code
• Scrape or copy protected content
• Interfere with platform operations
• Misrepresent Demen content as professional advice
• Use the platform to make emergency decisions without appropriate professional assistance

User Content

Users retain ownership of original content they submit, including stories, notes, photographs, wishes, and documents.

Users grant Demen a limited permission to store, process, display, and transmit that content only as reasonably necessary to operate the requested features.

Users represent that they have the right to upload and share submitted content.

Demen may remove content that violates these Terms, applicable law, or the rights or safety of others.

Advance Care Planning and Documents

Demen may provide general information, prompts, templates, or access to publicly available planning documents.

Demen does not guarantee that any form or document:

• Is appropriate for a user's circumstances
• Meets current state requirements
• Has been properly completed
• Has been legally executed
• Will be accepted by a healthcare provider, court, or agency
• Remains current after laws change

Users should consult a qualified attorney, healthcare professional, or appropriate state resource.

Funeral and Memorial Planning

Funeral, burial, cremation, obituary, memorial, and legacy features are intended to help users organize preferences and communicate wishes.

These preferences may not create a legally enforceable obligation.

Users should communicate directly with family members, legal representatives, clergy, funeral professionals, cemeteries, and other relevant providers.

Grief and Emotional Support

Demen may provide educational grief resources, journaling prompts, referrals, or supportive content.

Demen is not a therapy provider, crisis service, emergency service, or replacement for licensed mental health care.

Use of grief-related tools does not establish a therapist-client, social worker-client, physician-patient, attorney-client, or other professional relationship.

Professional Relationships

Unless explicitly stated in a separate written agreement, use of Demen does not create a professional relationship with:

• A social worker
• Therapist
• Physician
• Attorney
• Financial professional
• Funeral director
• Hospice provider
• Care manager
• Any other professional

Emergency Situations

For a medical or safety emergency, call 911 or the appropriate local emergency service.

For an emotional or behavioral health crisis in the United States, call or text 988.

Users outside the United States should contact appropriate local emergency or crisis services.

Intellectual Property

Demen's software, branding, interface, original educational content, graphics, trademarks, and design elements are owned by Demen or its licensors and are protected by applicable law.

Users may not reproduce, sell, modify, distribute, or create unauthorized derivative works from protected Demen content.

Third-Party Information and Services

Demen may reference third-party resources, forms, organizations, providers, websites, or services.

Demen does not control or guarantee third-party information, availability, quality, security, or outcomes.

Users are responsible for reviewing third-party terms and policies.

Availability and Changes

Demen may modify, suspend, improve, or discontinue features.

Demen does not guarantee uninterrupted access or that every feature will remain available.

Maintenance, technical problems, security events, or external service failures may affect availability.

Account Suspension or Termination

Demen may suspend or terminate access when reasonably necessary because of:

• Violations of these Terms
• Fraud
• Security concerns
• Abuse
• Illegal activity
• Threats to users or platform operations

Users may stop using Demen and request account deletion at any time.

Disclaimer of Warranties

Demen is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Demen does not guarantee that:

• Information will always be complete or error-free
• Documents will be legally valid
• Services will always be uninterrupted
• Recommendations will be suitable for every user
• Family members will agree with recorded wishes
• Use of the platform will produce a specific result

Limitation of Liability

To the fullest extent permitted by law, Demen and its owners, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.

Demen is not responsible for decisions made solely based on information in the app, lost or improperly shared documents, family disputes, professional outcomes, third-party services, or failure to seek appropriate professional assistance.

Nothing in these Terms excludes liability that cannot legally be excluded.

Indemnification

To the extent permitted by law, users agree to be responsible for claims, losses, or expenses resulting from:

• Their unlawful use of Demen
• Content they upload without authorization
• Their violation of these Terms
• Their infringement of another person's rights

Governing Law

These Terms will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, unless another law must apply.

Changes to These Terms

Demen may update these Terms as features, laws, or business practices change.

Material updates should be communicated through the app, email, or another reasonable method.

Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
